1. Who We Are

Versia Garden is operated by LASCAR NEGÓCIOS DIGITAIS LTDA (“Versia Garden”, “we”, “us”). By placing an order or starting a subscription on this website you agree to these terms. If you have any question about them, write to info@gardenversia.com before ordering.

2. Products and Availability

We sell flower seed packs for fall sowing, seed add-ons and a kitchen garden kit with digital trainings, and we offer two subscriptions (the Versia Seed Club and the Versia Garden app). Products are available to customers in the 48 contiguous United States and Washington, DC only — see our Shipping Policy. Seed varieties may be substituted for one of equal or greater value if a variety is unavailable; you will be told by email.

3. Seed Packaging, Labeling and Plant Safety

Every inner packet is labeled with the common and scientific name of the seed, a lot number, the statement “Packed for 2027” and the name and address of the packer, in line with the Recommended Uniform State Seed Law. The Monarch Meadow Mix is packed with the milkweed species native to the region of the state you ship to (common milkweed in the East and Midwest, showy milkweed in the West, butterfly weed in the South); the packet names the species included.

Toxicity notice. Rocket larkspur (Consolida ajacis) and milkweed (Asclepias species, in the Monarch Meadow Mix) are toxic if eaten. Keep seed packets out of reach of children and pets, and sow these varieties where pets and livestock do not graze. Seeds are for sowing only and are not for human or animal consumption.

4. Prices and Payment

All prices are in U.S. dollars. The total you pay — including the $7.95 shipping & handling fee on free promotional packs — is shown before you authorize the payment. Payments are processed by Stripe; the charge appears on your card statement as VERSIAGARDEN. Post-purchase add-ons offered after checkout are charged to the payment method saved for your order only when you click the button that names the amount.

5. Subscriptions (Automatic Renewal Terms)

The Versia Seed Club and the Versia Garden app are automatically renewing subscriptions. In line with the federal Restore Online Shoppers' Confidence Act and California's Automatic Renewal Law:

• Clear terms before you pay. The price, the billing frequency (yearly for the Seed Club, monthly for the app), the length of the free trial and the date of your first charge are shown next to the checkbox or button you use to join, and again on the checkout page before you pay.
• Affirmative consent. A subscription starts only when you tick the Seed Club box or click the app trial button yourself. Nothing is pre-selected and no subscription is started as a condition of receiving a free pack.
• Written confirmation. You receive an email confirming the terms, the trial end date and how to cancel, and a reminder before the first charge after a free trial.
• Cancel online, anytime. Every subscription email carries a one-click cancellation link that works without a login. You can also cancel by replying to any of our emails or through the contact form. Cancelling during the trial means you are never charged; cancelling later stops all future charges while access continues to the end of the paid period.
• Changes. If the price or the terms of a subscription change, you will be told by email at least 30 days before the change takes effect, with a way to cancel.

Seed Club: a first payment of $0.30 is taken from your checkout payment; the first yearly charge, less that $0.30, is made when the free trial ends, and the membership renews yearly at the price shown until you cancel. App: free for 30 days, then billed monthly at the price shown until you cancel.

6. Sprout Guarantee, Refunds and Cancellations

Seeds that don't sprout within 90 days are re-shipped free, without photos or forms. Full details, including refunds of add-ons and subscription charges, are in our Refund Policy.

7. Growing Results

Germination and flowering depend on soil, weather, timing and care, which we cannot control. Sowing windows in our guides are based on average first-frost dates for your state and are guidance, not a guarantee of a particular result. Our sprout guarantee is the remedy we offer when seeds fail.

8. Your Account and the App

Access to the Versia Garden app is tied to the email address used for your order. Keep your access code private. You may not resell, copy or redistribute the digital guides, courses or app content.

9. Limitation of Liability

To the fullest extent permitted by law, our liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these terms limits rights you have under the consumer-protection laws of your state that cannot be waived.

10. Governing Law and Disputes

We will always try to resolve a problem directly first — write to us and a real person will reply. These terms are governed by the laws applicable to the customer's state of residence in the United States, without prejudice to any mandatory consumer protection.
